1 general
1.1 PayDay offer
Payfresh AG operates the "PayDay" service (hereinafter referred to as "PayDay"). PayDay pays outstanding bills (mainly "utility bills" such as electricity, heating, telephone, school fees, etc.) or purchases of its customers up to the amount of the bill. The customer must repay the amount paid by PayDay, including fees, within 30 days (or 60 days). The repayment period shall in no case exceed three months. The service is offered exclusively online via the PayDay platform. PayDay's offer is only aimed at private individuals who are resident in Switzerland and have a regular income.
1.2 Registration, acceptance of the GTC and KYC
1.2.1 Registration process
Registration takes place online via the PayDay website. The interested party pays the one-off registration fee and/or the annual fee. Payment can be made online by credit card, Postfinance card, Paypal or within 7 days by invoice. If payment is not made within this period, the account is automatically closed and all customer data is deleted. The interested party can re-register if desired. The interested party can receive a verification code sent to their cell phone; this must be confirmed via the platform. They also receive an e-mail, which must also be confirmed by clicking on it, whereby the personal e-mail address of the interested party is verified. As part of the registration process, the interested party declares that they have carefully read and understood the GTC.
1.2.2 KYC (Know your Client) and credit check
As PayDay makes advance payments for its customers, it is extremely important for PayDay to know its customers and to ensure as far as possible that the information provided is correct and that the prospective customer will also be able to repay the invoices paid for him, including fees, within the deadline. As part of the registration process, a KYC check is therefore carried out on the one hand by checking the information provided by the interested party and on the other hand by means of our own investigations. In addition to the personal details, the interested party must upload the following documents to the PayDay platform: Passport / ID copy or foreigner's identity card the last 3 payslips or bank statements proving regular income in the context of employment or self-employment As soon as all documents and information are complete, they will be checked and confirmed by PayDay. PayDay reserves the right to request, obtain and exchange data with credit reference agencies and credit rating databases (e.g. ZEK, IKO, CRIF) for verification and credit checks. The additional costs incurred for this may be charged to the user with the user's consent. The interested party and customer expressly grants PayDay their consent to this by confirming these GTC. Once the registration and annual fees have been paid, the KYC requirements fulfilled and confirmed by PayDay (usually within 24 hours), the interested party officially becomes a customer and can use the PayDay service. This is to be distinguished from the legally required KYC check for the purpose of combating money laundering, which is carried out separately.
1.2.3 Correct and up-to-date information
The interested party and customer is obliged to provide PayDay with correct information. A person may only register once. Infringements (e.g. creation of fake profiles or similar) will be punished accordingly. The customer is also obliged to keep their personal details, information and the above-mentioned documents up to date at all times (e.g. in the case of an expired passport, ID, etc.). Job changes must be communicated on the platform immediately. PayDay may request an update of documents at any time. If the customer does not fulfill this obligation, PayDay can block the service. PayDay expressly reserves the right to claim damages if the customer uses the service even though their details are not up to date. PayDay may refuse or terminate a registration at any time and without giving reasons. Falsified and otherwise manipulated documents are also subject to legal action.
2 Use of the services
2.1 Usage window
The PayDay service is available to the customer during the so-called usage window. A usage window begins on the 5th of each month and ends on the last day of each month. PayDay does not process payments on public holidays and weekends. During a usage window, outstanding invoices up to a total amount of CHF 499.00 can be ordered for payment to PayDay. The amount of CHF 499.00 per usage window is a maximum amount. The customer can have several invoices paid by PayDay during this period until this maximum amount has been exhausted (see section 2.3). In the event that a customer already has overdue repayments from an invoice cycle, PayDay reserves the right not to release any further invoices for upload. The calculation is based on the actual amounts of the invoices or purchases submitted (excluding PayDay fees, etc.). The invoices may also be in the name of third parties. In this case, the debtor is and remains exclusively the PayDay customer, who is fully liable to PayDay. The third party shall at no time become a contracting party of PayDay. PayDay settles the invoices submitted by the customer, provided the formal details (such as correct reference number, etc.) are correct. PayDay may reject submitted invoices at any time without giving reasons. From the date of use of this service, the customer will receive an invoice including fees from PayDay. A new usage window will only be opened once this invoice has been paid.
2.2 Billing cycle
When the customer starts an order to pay invoices, he opens a so-called "invoice cycle" or "cycle". As part of a cycle, the customer can upload one or more invoices to the PayDay platform for payment. A cycle lasts from 00:01 to 23:00. If a customer uploads an invoice in the morning at 08:00, he can edit the cycle again in the evening and add the second or further invoices. The minimum amount of an invoice is CHF 50.00. The minimum amount per cycle is CHF 100.00.
2.3 Payment of an invoice by PayDay
Payment by PayDay is made on behalf of the debtor. Payment by PayDay does not constitute an assumption of debt; the original debt relationship between the user and the respective contractual partner remains unaffected at all times.
3 Fees, payment modalities and consequences of default
3.1 Basic fees
3.1.1 Registration fee
PayDay does not charge interest, but only low service fees. In order to continue to ensure this, the one-off registration fee is used for the manual verification process. If the one-off registration fee has been paid but the information and documents required for the KYC check have not been provided in full, a refund is excluded.
3.1.2 Annual fee
A contribution towards expenses may be charged for the credit check. A refund of this amount is excluded, even if the user is not accepted. The annual fee is CHF 19.90. If the annual fee has been paid but the information and documents required for the KYC check have not been provided in full or are out of date, a refund is excluded. If the contract is terminated prematurely, there is no entitlement to a pro rata refund of the annual fee. Upon payment of the annual fee and successful verification, the customer can use the platform for one year without restriction and recurring credit check measures for the respective use of our service are no longer necessary.
4 Fees for the services
4.1 Basic fee for the bill payment service
The basic fee per cycle is CHF 24.80 and includes the payment of one invoice. The customer pays CHF 4.90 for each additional invoice in the same session. For example, if the customer submits three invoices to us for payment, 1st CHF 175.00, 2nd CHF 125.00, 3rd 150.00 = total CHF 450.00, then the customer pays a total of CHF 484.60 back to PayDay within 30 days.
4.2 Administrative fees
If the customer wishes to receive invoices in paper form, PayDay will charge a flat rate of CHF 2.50 per invoice/reminder issued. The fees incurred for payments made at the post office counter using payment slips will be charged to the customer's account at a flat rate of CHF 1.50. As this can only be determined after an invoice has been paid, the usage amount is then reduced by this amount and will only be charged the next time the service is used.
4.3 Charges for optional services
The customer has various options for extending the repayment period for credits granted by PayDay. "Buy more Time" option 1: CHF 19.90 This option can be used from the 20th - 24th day after using the service. The customer receives an additional 30 days. If the "buy more time" option is selected, the customer will receive a new invoice including the relevant fee. The payment term of this invoice is then extended by 30 days of the original payment term.
4.4 Payment modalities
The customer receives an electronic invoice for the services used by e-mail or, on request, in paper form. Each invoice can also be viewed in the personal profile on our platform. Payment of the respective invoice amount must be made by the payment date stated on the respective invoice at the latest.
4.5 Consequences of default
4.5.1 Reminder
The first reminder is sent 30 days after the due date with a fee of CHF 25.00. The second reminder is sent 10 days later with a fee of CHF 25.00. The third reminder is sent a further 10 days later with a fee of CHF 40.00. After a further 10 days, the file is automatically handed over to a debt collection agency.
All reminders are sent by e-mail.
4.5.3 Reactivation fee
A reactivation fee of CHF 35.00 is due if an account has been blocked and is to be reactivated after the current membership has expired. Reactivation is only possible if all claims have been paid to debt collection and the usual guidelines have been met.
4.6 Examples for the calculation of fees
On January 7, 2 invoices totaling CHF 280.00 were ordered for payment. The customer receives a repayment invoice of CHF 309.70 (CHF 280.00 paid by PayDay + CHF 24.80 basic fee + CHF 4.90 for the second invoice = total CHF 309.70).
On January 24, the customer ordered another bill totaling CHF 170.00 for payment. The customer receives a repayment invoice of CHF 194.80 for this cycle (CHF 170.00 paid by PayDay + basic fee of CHF 24.80 = total CHF 194.80).
In this case, a new usage window will only be reopened for this customer once the customer has paid both invoices in full. If the outstanding invoices have been repaid in full, the new usage window is reopened on the following day and the customer can use the PayDay service again up to a total amount of CHF 499.00.
The usage window closes on the last day of each month at 11.59 pm, even if the customer has not used the full amount of up to CHF 499.00. Here too, the usage window remains closed until the outstanding invoices have been paid in full. From the 1st to the 5th of each month, PayDay will not settle any invoices.
5 Data protection
The customer agrees that PayDay may process personal data for the purpose of providing the services. Further information on data processing can be found in the privacy policy.
6 Term & termination
6.1 Contract term / premature termination
After registration, the customer has the option of using the platform for one year. The expiry date, which is shown on the platform (usually 365 days from the date of payment of the annual premium), is decisive for the period of use and thus the contract period. The customer relationship is not extended automatically, but must be confirmed and paid for before it expires. The PayDay system sends a reminder by e-mail and a note on the platform itself before the expiry date.
6.2 Premature termination
PayDay may terminate the contract prematurely at any time without giving reasons. Early termination occurs in particular - but not conclusively - if the customer is so far in arrears with his payment obligation that the dossier must be handed over to debt collection. In such a case, the service is automatically terminated and the customer remains blocked for the entire current membership year. This applies even if the customer has paid the invoice via debt collection in the meantime. The customer may terminate the contract at any time within 30 days of notification of changes to the GTC. Any outstanding repayment obligations remain in force. There is no refund or partial refund of the annual premium.
7 Further provisions
7.1 Changes to the GTC
PayDay reserves the right to amend the GTC (including adjustments to the services and the applicable fee, etc.) at any time. Changes will be communicated in writing or in another appropriate form and are deemed to have been approved if the service is not terminated by PayDay before the changes come into effect.
7.2 Severability clause
Should individual provisions of this contract be or become invalid in whole or in part, or should this contract contain a loophole, this shall not affect the validity of the remaining provisions of this contract. The contracting parties hereby undertake to replace the invalid provision with a legally valid provision which - from an economic point of view - comes as close as possible to the meaning and purpose of the invalid provision.
7.3 Applicable law, place of jurisdiction
This contract is subject to Swiss law. The place of jurisdiction is Zurich, subject to mandatory statutory jurisdiction provisions.
8 Combating money laundering
PayDay AG undertakes to strictly comply with the legal requirements for combating money laundering (AML) and terrorist financing in accordance with Swiss regulations. Identification of customers (KYC): PayDay carries out a comprehensive identity check of all customers before providing services. Customers must provide a copy of their passport or identity card and the last three payslips or bank statements to confirm their identity and ability to pay. Due diligence: PayDay continuously monitors transactions to ensure that they comply with legal requirements and that there is no suspicious activity. In the event of anomalies, further checks are initiated. Cooperation with authorities: In cases of suspicion or mandatory reporting, cooperation takes place with the relevant Swiss authorities (e.g. the Money Laundering Reporting Office Switzerland MROS). Training and processes: PayDay regularly trains its employees on the prevention of money laundering and implements internal processes to ensure compliance with AML requirements at all times. Legal consequences: PayDay reserves the right to refuse services, block accounts or terminate the contract if violations of the AML guidelines are detected or if money laundering is suspected. These measures ensure that PayDay proactively contributes to the fight against money laundering and guarantees compliance with Swiss legal requirements.
9 Exclusion of liability for platform malfunctions and payment delays
PayDay accepts no liability for technical malfunctions, failures or interruptions of the platform that could affect the use of the services. This includes, in particular, delays in the transmission of invoices or payments due to technical problems. PayDay is also not liable for financial losses or damages caused by delays or malfunctions, unless these were caused by gross negligence or intent on the part of PayDay.
PayDay is not liable for reminder fees, interest on arrears or other costs arising from late payment to third-party providers. The customer is responsible for the timely submission of invoices and their payment.
The customer undertakes to report technical problems immediately so that they can be rectified promptly.
